A 24-lot residential subdivision will not go ahead in Hampton Park after a decision by the Supreme Court of Victoria.
The court overturned a decision made by the Victorian Civil and Administration Tribunal (VCAT) to develop a site adjacent to the Hallam Road landfill and a concrete batching plant.
Casey Council refused the original application for the development on 25 November 2008, based on the potential effects in the proximity of the site.
VCAT later overturned the decision and approved the subdivision.
The council commenced proceedings, arguing VCAT had made an error.
The Supreme Court found in the City of Casey’s favour.
City of Casey Mayor Shar Balmes said the decision by the court made the action worthwhile.
“The decision handed down by the Supreme Court to refuse the proposed residential development is a great outcome for the local community,” she said.
“We’ve all seen the significant consequences that can occur as a result of poor land-use decisions, as was the case with the Stevensons Road closed landfill.”
